Excelsior jobs program credit reports: beginning calendar year 2012

For tax years beginning on or after January 1, 2011, a taxpayer participating in the Excelsior jobs program who has been certified by Empire State Development (ESD) may be eligible for a tax credit comprised of four credit components focused on certain strategic industries such as biotechnology, pharmaceutical, high-tech, clean-technology, green technology, financial services, agriculture, manufacturing and life sciences. The components of the credit are:

  • Excelsior jobs tax credit component
  • Excelsior investment tax credit component
  • Excelsior research and development tax credit component
  • Excelsior real property tax credit component

Chapter 59 of the Laws of 2010 requires the Tax Department to produce an Excelsior jobs program credit report by June 30th of each year. Information in the report is based on the information filed with the department during the previous calendar year, to the extent that it is practicable to use the information. The mandate requires the department to include the name of each taxpayer claiming the Excelsior tax credit, the amount of each credit component earned by the taxpayer, and any other information received regarding the credit which the commissioner deems useful in evaluating the use of the credit.
