Empire State Jobs Retention Program Credit
Who is eligible?
Taxpayers whose business operations have been impacted by natural disasters may be eligible for the refundable Jobs Retention Program Credit, administered by Empire State Development (ESD). Taxpayers must apply to and receive a certificate of tax credit from ESD. If approved, the certificate lists the amount of credit.

How much is the credit?
For a business that employes:
- 3 to 49 employees, the credit is equal to 15% of gross wages paid for jobs impacted by the natural disaster.
- 50 to 100 employees, the credit is equal to 7.5% of gross wages paid for impacted jobs.
- 101 or more employees, the credit is equal to 3.75% of gross wages paid for impacted jobs.
Note: The total credit per emergency event cannot exceed $500,000.
